SSA didn’t respond to the request. AND, when LP de
Juliis returned from lunch, LP de Juliis was assaulted
by District Manager Huerta! As de Juliis reported to the

ON February 6, I emailed Tulsa management that I would
like 4 hours of EEO time that
afternoon to work on the response to SSA's discovery on
XXXXXs' EEO complaint:
I was returning to my desk from lunch at about 1:45.
Tulsa District Manager Eliazar Huerta was coming out of
the mail room. He asked me if I was going to be
answering the General Inquiry Telephone lines. I
responded that I had sent him an email for time this
afternoon to respond to SSA's discovery on Xxxxxx's EEO
case. BUT, I added,
if he denied my time, I was certainly going to be
answering the GI line.
We were right outside my cubicle on the office floor. I
started to turn to sit down in
my chair. He grabbed my upper arm as I turned away
to sit down so that I couldn't turn away or sit down. He
asked me again, in a higher pitched,
louder voice: "Are you going to be answering
the phones?" I replied, again, that if he denied my
request for time to respond to SSA's discovery on
Emily's EEO, I was going
to answer the phone. He let my arm go; he walked away.
I sat down in my chair.
I was physically assaulted by the Tulsa District Manager
Eliazar Huerta after he found out that I was
going to acting an EEO representative. Tulsa SSA did not
file an incident report on this assault as
they are required to do.
His action was clearly intended to intimidate me as an
EEO representative and inhibit / prohibit me from acting
as an EEO representative.
His physically grabbing me / assaulting me is clearly
prohibited by SSA policy. See:

assault, threatening behavior, or verbal abuse occurring
in the work setting." Under this definition, even
disorderly conduct, including pushing, throwing or
slamming objects, and verbally threatening or harassing
employees, are classified as instances of workplace
violence. Other examples of workplace violence include
extortion, and any explicit (verbal) or non-verbal
communication that implies harm or shows intent to harm.

On Monday, February 6, 2012, AFGE Local 2505 President
Ralph de Juliis was the victim of a physical assault by
Tulsa OK District Manager, Eliazar Huerta. Mr. Huerta
approached Mr. de Juliis, who is also a Claims
Representative in the Tulsa office, and gave him a work
assignment. When Mr. de Juliis reminded him that he had
requested time to respond to an Agency discovery request
with re4gard to an EEO case that he was handling, Mr.
Huerta grabbed his arm while Ralph was trying to sit
down. This prevented Mr. de Juliis from sitting down.
While grabbing his arm, Mr. Huerta raised his voice and
in an intimidating manner repeated his work assignment.
Mr. de Juliis again responded that he would complete the
work assignment if his request for EEO time to respond
to SSA’s discovery request was denied by Mr. Huerta.
Finally, Mr. Huerta released his grip on Ralph’s arm and
Mr. Huerta’s physical restraint of AFGE Local 2505
President Ralph de Juliis is extremely disturbing. Such
action constitutes workplace violence and is completely
unacceptable behavior. Assault of union officials and
bargaining unit employees in SSA offices cannot be

In view of the fact that I am receiving a number of
reports regarding SSA manager’s aggressive behavior
directed at bargaining unit employees, it is time for
SSA to provide mandatory training for managers regarding
the unacceptability of workplace violence and actions
that SSA will take if managers engage in such prohibited
